GENERAL TERMS AND CONDITIONS (hereinafter referred to as "GTC")

PARTIES TO THE CONTRACTUAL RELATIONSHIP

The business entity Pod Vojtěchem, spol. s.r.o., with its registered office at Amerika 24, Votice, 25901, registered under identification number 19970714 (the company is registered in the Commercial Register kept by the Municipal Court in Prague, Section C, Insert 394622), hereinafter referred to as the "accommodator," is the operator of the private Wellness Pod Vojtěchem at Amerika 24, Votice, 25901 (hereinafter referred to as "Wellness Pod Vojtěchem").

on one side, and

a natural or legal person (hereinafter referred to as the "customer") ordering accommodation for themselves or other persons from the accommodator.

RESERVATION OF ACCOMMODATION AND SERVICES

Reservations for accommodation and other services at Wellness Pod Vojtěchem and the confirmation of such reservations by the accommodator can be made based on a written order sent to the accommodator's email info@podvojtechem.cz, through the web form on the accommodator's website, or through the websites of intermediaries providing online reservation services, or by phone to the manager at +420724973922.

Essential elements for a properly issued order include: billing information (name and surname of the customer, address of permanent residence (in the case of legal entities, business name, ID number, VAT number, and registered office), contact information (phone and email), and the requested date of accommodation and the number of guests.

By sending the order created in this way to the accommodator, the customer confirms that they have fully read these GTC, agree with them, and acknowledge them as the conditions and an integral part of the accommodation contract.

In the case of reservations made directly with the accommodator, the accommodator will send the customer a confirmation of the reservation to the email address provided in the order. This confirmation will include at least the identification of the customer, the accommodation period, the total price for accommodation, the amount of the accommodation deposit and its due date, the amount of the accommodation balance, and the due date.

The accommodation contract is concluded at the moment of delivering the confirmation of the reservation.

In the case of a reservation made directly with the accommodation provider, the provider will send the confirmation of the reservation to the guest's electronic address provided in the order. The confirmation will include at least the identification of the guest, the accommodation period, the total accommodation cost, the amount of the accommodation deposit, its due date, the amount of the accommodation balance, and its due date.

The accommodation contract is concluded at the moment of delivering the confirmation of the reservation.

In the case of a reservation made through external providers, it is confirmed by the respective online reservation system.

The information provided on the confirmation of the reservation is binding for both parties.

Individual conditions may be specified.

PRICES, CANCELLATION, AND PAYMENT CONDITIONS

The price is stated per night, including VAT at 10%, and includes accommodation, wellness rental, a fee for accommodation capacity paid to the town of Votice, and final cleaning.

Reservations made directly with the accommodation provider are subject to the following conditions:

Valid prices are listed on the accommodation provider's website www.podvojtechem.cz.
The price stated in the reservation confirmation is binding.
The accommodation provider requires the guest to pay a deposit for the accommodation, amounting to 50% of the total accommodation cost.
The guest is obligated to settle this deposit no later than the deadline specified in the reservation. This deadline is also indicated on the invoice. If the guest fails to properly and timely pay this deposit, the accommodation provider has the right to withdraw from the accommodation contract in writing and offer the accommodation capacity to another person. The deposit is not required for stays reserved 30 or fewer calendar days before the desired check-in date. In such a case, the full accommodation cost is payable within the deadline specified in the reservation, as also indicated on the invoice.
The guest must settle the remaining portion of the accommodation cost no later than the deadline specified on the invoice. If the remaining amount is not paid within the specified deadline, the accommodation provider has the right to withdraw from the contract and the right to payment of a contractual penalty equal to the paid deposit.
Tax documents for received payments are issued within the legal deadline.
In the event of early termination of the stay, the guest is not entitled to a refund of the accommodation cost.
Payment is considered made when the relevant amount is credited to the accommodation provider's bank account no later than the last day of the deadline.
Cancellation of a confirmed reservation can only be made in writing, i.e., via email.
Changes to the reservation, such as moving ordered services to another date, are considered as the cancellation of the original reservation and are governed by the same conditions as reservation cancellations.
Accommodation can only be paid by non-cash means, and we accept the currencies CZK, EUR, and USD.

Reservations made through external providers are exclusively governed by the conditions set by them.

ACCOMMODATION CONDITIONS

Accommodation is provided in the form of private accommodation.

The accommodation provider does not provide meals.

Check-in is possible from 3:00 PM on the first day of the accommodation period specified in the reservation, unless agreed otherwise.

Check-out from accommodation must take place no later than 11:00 AM on the last day of the accommodation period specified in the reservation, unless agreed otherwise.

Guests have the right to use the designated accommodation spaces, including common areas, and avail associated services.

Guests are obligated to adhere to the Wellness Pod Vojtěchem accommodation rules, accessible on the accommodation provider's website www.podvojtechem.cz and at the main entrance to the interior of Wellness Pod Vojtěchem. By placing an order, the guest confirms familiarity with the accommodation rules.

The guest is required to familiarize all accommodated persons with the accommodation rules.

Pet accommodation is possible with prior notice to the accommodation provider.

The guest is responsible for any damage caused to the accommodation provider's property by themselves, guests, or other individuals granted access to Wellness Pod Vojtěchem by the guest.

Transportation to Wellness Pod Vojtěchem is individual. Parking of motor vehicles is allowed only in the covered parking area located at the entrance to Wellness Pod Vojtěchem.

WITHDRAWAL FROM THE AGREEMENT AND CANCELLATION FEES

The guest has the right to withdraw from the accommodation contract in writing at any time before the arrival of guests at Wellness Pod Vojtěchem, due to a material breach of the accommodation provider's obligations, without the obligation to pay a cancellation fee.

In case of withdrawal from the accommodation contract for other reasons, and also if the accommodation provider withdraws from the accommodation contract for reasons specified by law or these Terms and Conditions, the guest is obliged to pay the cancellation fee to the accommodation provider.

The amount of the cancellation fee is agreed upon depending on the time remaining from the date of receipt of the accommodation contract withdrawal to the date of arrival for accommodation specified in the reservation, as follows:

If the withdrawal from the accommodation contract is received more than 21 days before the first day of the accommodation period specified in the reservation, no cancellation fee will be applied to the guest.
If the withdrawal from the accommodation contract is received less than 21 days before the first day of the accommodation period specified in the reservation, the cancellation fee is 100% of the accommodation cost.

If guests do not check-in at Wellness Pod Vojtěchem by 12:00 AM on the first day of the accommodation period specified in the reservation and the guest does not inform the accommodation provider of a late arrival, the accommodation provider may withdraw from the accommodation contract. In these cases, the guest is obliged to pay 100% of the accommodation cost specified in the reservation.

Withdrawal from the accommodation contract must be in writing and must be delivered to the other party.

The accommodation provider is entitled to terminate the accommodation contract before the agreed-upon accommodation period without stating a reason.

The accommodation provider is entitled to terminate the accommodation contract during the agreed-upon accommodation period if the guest, guests, or other individuals granted access to Wellness Pod Vojtěchem by the guest grossly violate their obligations arising from the accommodation contract, these Terms and Conditions, the accommodation rules, as well as the laws of the Czech Republic.

RIGHTS AND OBLIGATIONS OF GUESTS

Guests have the right to use reserved spaces and their equipment, as well as the equipment of common areas.

The maximum number of persons accommodated in Wellness Pod Vojtěchem is 2. This number does not include pets. This limit applies to all indoor and outdoor areas of Wellness Pod Vojtěchem.

Exceeding the maximum number of persons accommodated, as stated above, entitles the accommodation provider to charge the guest a contractual penalty of 5000 EUR.

The use of outdoor areas of Wellness Pod Vojtěchem for camping or the use of trailers or caravans in the area of Wellness Pod Vojtěchem is prohibited. Violation of this regulation entitles the accommodation provider to charge the guest a contractual penalty of 5000 EUR.

The guest is responsible for any damage caused by themselves, guests, or other individuals granted access to Wellness Pod Vojtěchem by the guest, and agrees to pay any costs for repairs, replacements, or special cleaning. The amount of payment will be determined by the accommodation provider.

Smoking is prohibited in all indoor areas of Wellness Pod Vojtěchem. Violation of this regulation entitles the accommodation provider to charge the guest a contractual penalty of 500 EUR. Smoking is only allowed in outdoor areas designated for this purpose. Discarding cigarette butts outside designated areas is strictly prohibited.

Guests of Wellness Pod Vojtěchem are not allowed to move any furniture and equipment or make any interventions into the electrical network and equipment located in Wellness Pod Vojtěchem. For safety reasons, guests can only use electrical appliances owned by Wellness Pod Vojtěchem and those used for personal hygiene (hairdryers, razors, etc.), as well as laptops, tablets, mobile phones, and similar small electrical appliances.

Within the accommodation at Wellness Pod Vojtěchem, any racist, violent, xenophobic, obscene, or otherwise illegal behavior is not allowed.

Guests are entitled to free use of wireless internet access via wifi in all areas of Wellness Pod Vojtěchem.

Guests are allowed to use the iron fireplace with a grilling plate located in the garden for grilling. Moving this fireplace within the facility, especially onto the wooden terrace, is prohibited. Violation of this regulation entitles the accommodation provider to charge the guest a contractual penalty of 5000 EUR.

Guests are allowed free charging of electric bikes at a designated location in the garage.

Guests are allowed, for a fee, to charge electric vehicles in the garage by prior arrangement.

The use of Wellness Pod Vojtěchem for political, propaganda, or religious purposes without the consent of the accommodation provider is not allowed.

Recording any audiovisual materials from Wellness Pod Vojtěchem for commercial purposes without the consent of the accommodation provider is not allowed.

The period from 10:00 PM to 6:00 AM is the nighttime quiet time.

PROTECTION OF PERSONAL DATA

The accommodation provider processes the personal data of the guest and hosts in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, the General Data Protection Regulation, and Act No. 110/2019 Coll., on the processing of personal data ("Personal Data Processing Act").

The legal basis is the fulfillment of contractual obligations, defense of legitimate interests of the accommodation provider, and compliance with legal obligations. The accommodation provider collects personal data of the guest and hosts for the purpose of order and reservation fulfillment, fulfillment of contractual obligations related to offered services, and fulfilling the obligation to register guests for calculating the amount of local stay tax, for the time necessary until the termination of the provision of agreed-upon services.

In the above cases, the accommodation provider, in accordance with § 43 (3) letters a), b), and e) of the Personal Data Processing Act, is authorized to process the personal data of the guest and hosts without their consent.

Personal data is processed only to the extent required by law or to the extent necessary, including basic contact information and identification details of a specific natural or legal person.

The accommodation provider processes the personal data of the customer in the following scope: customer's name and surname, permanent address, in the case of legal entities, business name, identification number, tax identification number, and registered office, contact information (phone and email).

The accommodation provider processes personal data of each guest in the following scope: name and surname, date of birth, identification document number and type, permanent address, and start and end dates of the stay at Wellness Pod Vojtěchem.

The accommodation provider processes personal data as a controller and does not provide these data to other persons.

In connection with the processing of the customer's and guests' personal data, the customer and guests have the following rights related to processing, among others:

Right to access personal data;
Right to rectify personal data;
Right to request an explanation and removal of the situation if personal data is processed in violation of the law.

FINAL PROVISIONS

These General Terms and Conditions in accordance with § 1751 et seq. of the Civil Code regulate the procedure for concluding, form the content, and are an integral part of the accommodation contract concluded between the customer and the accommodation provider.

If a written form of legal action is required in these General Terms and Conditions, this form is considered fulfilled if the legal action is taken in the form of a letter or email.

The accommodation provider may supplement and modify these General Terms and Conditions in full and without limitation in electronic form. The new version of the General Terms and Conditions will always be placed on the accommodation provider's website www.podvojtechem.cz, and they become effective at the moment of publication.

In other cases not regulated by these General Terms and Conditions, the customer and the accommodation provider undertake to comply with the relevant laws of the Czech Republic and resolve any disputes preferably through amicable means.

These General Terms and Conditions come into effect and become effective on November 21, 2023.
